General Provisions

  1. The Terms and Conditions define the terms of use and operation of the Website www.ochotnicy.waw.pl.

  2. Each User is obliged to read the Terms and Conditions before using the Portal and to comply with them.

  3. The cooperation between the Organiser and the Recipient is free of charge.

  4. The Administrator is not a party to the agreements concluded by the Organiser and the Recipient, but only provides the possibility of using the Portal free of charge.

  5. Starting to use the Portal is tantamount to accepting these Terms and Conditions.

Definitions

  1. The Administrator of the website www.ochotnicy.waw.pl is the Warsaw City Hall with its registered office in Warsaw, at pl. Bankowy 3/5, Tax ID No. [NIP] 525-22-48-481, National Business Register Number [REGON] 015259640.

  2. Portal – this means the online website available at www.ochotnicy.waw.pl, enabling registered Users to use the following functionalities:

    • Creating an individual account for the Recipient.

    • Creating an account for the Organiser.

    • Allowing the Organisers to post volunteering offers along with information enabling Recipients to contact the Organiser in order to undertake volunteer work.

    • Managing the relationship between the Organiser and the Recipient, including, among others, volunteer recruitment, event creation, file sharing, creating worksheets, generating documents, sending messages (when enabling the appropriate modules for the offer for which recruitment takes place via the Portal).

    • Browse volunteer opportunities, search for them and sort them according to various criteria.

    • Access to news, articles and other materials about the volunteer work.

    • For Recipients to issue recommendations to the Organisers.

    • Sharing volunteering offers and content posted on the Portal on social media.

    • Registration for events available in the calendar.

  3. User – this means:

    • Natural persons from 13 years of age, hereinafter referred to as "Recipients". Minors under 18 years of age may use the full functionality of the Portal only after obtaining the consent of a parent or legal guardian.

    • Entities organising volunteering which, in accordance with Article 42 of the Act of 24 April 2003 on Public Benefit and Volunteer Work, may benefit from services provided by volunteers, hereinafter referred to as "Organisers".

    • Entities cooperating with the Administrator, hereinafter referred to as "Partners".

  4. Offer – this shall be understood as a proposal to engage Recipients in volunteer work, formulated on the Portal by the Organiser, entitled to use such benefits under the Act of 24 April 2003 on Public Benefit and Volunteer Work.

  5. Relationship management – this means the URM (user relationship management) functionalities that Users can use when recruitment in the Offer is carried out via the Portal.

User Account on the Portal

  1. The User sets up an account independently.

  2. The condition for registration is to provide correct and true personal data.

  3. In the case of a User who is under 18 years of age, it is necessary to provide an additional e-mail address of a parent or legal guardian.

  4. During registration, a confirmation link is sent to the e-mail address provided by the User. In the case of a User who is under 18 years of age, a confirmation link is sent to the address of the parent or legal guardian to confirm consent.

  5. In special cases, at the User's request sent to ochotnicy@um.warszawa.pl, it is possible to restore the password or activate the account by the Administrator.

  6. The Recipient's or Organiser's account is deleted upon a request sent to the e-mail address: ochotnicy@um.warszawa.pl from the e-mail address assigned to a given type of account.

  7. In special cases, e.g. when the Organiser does not have access to the account or does not have access to the e-mail address assigned to a given account, the Administrator may make changes to the account settings or delete the account. Such changes are made at the request of the Organiser, after verification of his identity.

  8. The Administrator reserves the right to delete the User's account, especially in cases of violation of the Terms and Conditions.

  9. The Administrator is not responsible for the consequences of disclosing the login and password to unauthorised persons resulting from the User's fault.

  10. The Administrator is not liable for any damage or inability to use the User's account caused by:

    • providing false data during the registration process, including an incorrect e-mail address or an address to which the User does not have access,

    • failure to perform or improper performance of operations carried out via the Portal, if this was caused by a tele-transmission or technical defect, device failure or connection interruption, for reasons beyond the Administrator's control,

    • force majeure, i.e. an external event beyond the Administrator's control.

  11. The contact details of the Organisers will be made publicly available on the Portal.

  12. The Organiser's account may be managed by several Users. Every User in the organisation has the ability to use the same functionalities.

Posting Volunteering Offers on the Portal

  1. Entities with an Organiser account verified by the Administrator may post Offers on the Portal.

  2. Each element of the Offer should be described in a factual manner that allows the Recipient to make a decision about engaging in a given volunteer work.

  3. The Offer, after being formulated and approved by the Organiser, is awaiting the Administrator's approval. After acceptance, the Offer is published on the Portal.

  4. The Administrator is not responsible for the content and form of Offers entered into the Portal.

  5. The Administrator reserves the right to accept only those offers that are in accordance with the Terms and Conditions and generally applicable law. In the event of a violation of the law or the Regulations, the Offer may be removed from the Portal.

  6. The Administrator will remove offers containing:

    • Content that is vulgar, offensive, indecent, profane or otherwise controversial.

    • Information containing threats or insults, intimidating language, or promoting hatred.

    • Content that infringes in any way the rights of third parties.

    • Glaring omissions or worded in a way that makes it impossible to understand the content of the tasks, project description or other information.

    • Content regarding forms of engagement other than volunteering, e.g. paid job offers.

    • Questions defined by the Organiser in the case of recruitment via the Portal, which do not directly relate to recruitment for a given volunteer work.

    • Elements defined by the Organiser in the relationship management functionality that do not directly relate to a given volunteer work or contain the content specified in this section.

Recruiting Volunteers Using the Portal

  1. An individual User account is not required to view volunteer offers.

  2. The portal allows you to recruit volunteers in three ways:

    • Through the Portal, which involves submitting to the Organiser an application form completed by the Recipient,

    • By providing the Recipient with the internet address of the external application form prepared by the Organiser;

    • By providing the Recipient with an e-mail address.

  3. Each volunteer offer includes an "apply" button allowing you to apply to volunteer or obtain contact information.

  4. In order to apply for a volunteering Offer in which recruitment takes place via the Portal, the Recipient must create an account on the Portal.

  5. Establishing volunteer cooperation takes place without the Administrator's participation. The Administrator is not a party to agreements concluded in this respect by Recipients and Organisers.

  6. The Organiser is obliged to respond to the Recipient's application for a volunteer work, regardless of whether it was received via the Portal, via e-mail or via an external website. A response should be provided regardless of whether it means initiating cooperation or refusing to cooperate.

  7. If the Administrator receives information from the Recipient about the lack of a response to their application, it requests the Organiser to immediately send such a response to the Recipient.

  8. The Administrator reserves the right to permanently remove from the Portal the account of an Organiser who repeatedly fails to respond to Recipients' applications. The Organiser is notified of the intention to delete the account via e-mail sent to the address assigned to his account.

  9. In correspondence undertaken when establishing cooperation with Recipients, the Organisers are obliged to apply the standards for organising volunteer work, available in the Organiser's Knowledge Base.

Technical Requirements for Using the Portal

  1. To use the Portal, the User must have a device with a web browser that supports cookies and JavaScript.

  2. The condition for using certain functionalities on the Portal may be that the User has an e-mail account, of which the User will be informed before using such functionality.

  3. Particular risks associated with the use of the Portal by Users include using it without applying the security measures described in the web browser documentation. This applies to mechanisms that extend browser capabilities with functions that go beyond the HTML standard. If browser security is incorrectly configured, data sent to and from the web server can be intercepted.

  4. Using the Portal requires providing basic information about the User's device, such as: IP address, domain, address of the previously visited website (the website from which the User connected to the Portal by selecting the appropriate link), the User's browser, operating system, etc., collected in cookies, to which the User consents.

Administrator's Obligations and Liability

  1. Statements posted on the Portal by Users express the point of view of the people who post them. Users publish content, including comments and photos, solely at their own risk.

  2. The Administrator is entitled to remove any content that he or she becomes aware of as unlawful, or if it contains:

    • vulgar, offensive, hate-promoting, indecent, profane or otherwise controversial expressions,

    • threats, invectives or intimidating speech,

    • expressions that in any way violate the rights of third parties.

  3. The Portal may be modified, updated or rebuilt by the Administrator without notice at any time.

  4. The Administrator will take all necessary measures to ensure permanent access to the Portal. However, the Administrator reserves the right to periodically suspend the operation of the Portal or terminate its operation, without giving any reason and without prior notice, in particular in the cases referred to in Section 3.

  5. The Administrator shall not be liable for any direct, indirect, accidental, intentional or other damages, losses, deficiencies or other accidents caused as a result of activities related to access, use or downloading materials from the Portal and their further use. In particular, it shall not be liable for any damage resulting from interruptions in access to the network and the Portal, as well as computer system errors caused by reasons beyond the Administrator's control.

  6. The Administrator is not responsible for the consequences of non-performance or improper performance of obligations incurred by Users via the Portal.

  7. The Administrator reserves the right to delete, move or close access to any content, including photos or topics, without giving a reason, and also has the right to block participation in the Portal in relation to persons or entities violating the provisions of these Terms and Conditions, in particular whose actions are harmful to the Portal or other Users.

  8. The Administrator has access to data in the system subject to Section 9 of this Article.

  9. The Administrator does not have access to messages sent on the Portal by default. Messages may be shared in cases provided for by law.

Intellectual Property

  1. The Portal and the materials and information contained therein, in particular texts, navigation solutions, the selection and arrangement of the content presented on the Portal, trademarks, graphic elements, interactive applications, audio and video materials, and studies are the property of the Administrator, excluding those that constitute separate property of other entities. The materials covered in this Section may be made available under the CC BY-SA 4.0 license (Attribution – ShareAlike 4.0 International) with the consent of the Administrator, excluding legally protected materials.

  2. The User who makes any materials available on the Portal to other Users grants the Administrator a non-exclusive, royalty-free license to use such materials and works in the fields of exploitation indicated in Article 50 of the Act on Copyright and Related Rights, for an indefinite period. The Administrator informs that the materials will be made available under the CC BY-SA 4.0 license (Attribution – ShareAlike 4.0 International).

  3. If the User places a work within the meaning of the Act of 4 February 1994 on Copyright and Related Rights, a trademark or other intellectual property item on the Portal, it is presumed that the User is entitled to use this work or item in the above-mentioned manner. By posting this work or item on the Portal, the User consents to its public disclosure via the Portal.

  4. The User is obliged to ensure that the materials posted on the Portal do not infringe the rights of third parties, in particular property or personal copyrights and related rights, personal rights and personal data, and in particular do not infringe the right to one's image. In the event of such a breach, the User shall satisfy all claims made by third parties and release the Administrator from the obligation to satisfy such claims, as well as reimburse the Administrator in full, together with statutory interest, for all costs incurred by the Administrator as a result of failure to comply with these obligations.

  5. The Administrator is not responsible for the use of materials posted on the Portal by other Users.

Privacy and Personal Data Protection

  1. User privacy protection issues are regulated by the "Privacy Policy" (linked under "Privacy Policy").

Final Provisions

  1. Use of the Portal is free of charge and is not restricted in any way.

  2. The Administrator reserves the right to make changes to these Terms and Conditions at any time. The Terms and Conditions apply from the date of their publication.

  3. In all matters relating to the use of the Portal, the relevant provisions of law in force in the territory of the Republic of Poland shall apply.

  4. These Terms and Conditions are available in Polish and English. In case of any doubts as to interpretation, the Polish version of the Terms and Conditions shall prevail.
